The following information describes how the company Alpin Resort Montafon GmbH (as the “data controller”) processes your personal data, which we collect when you visit our website, and in particular when you register as a Prospective Buyer or Bidder in our “Alpin Resort Montafon” portal, as well as your use of our services offered via this portal (hereinafter referred to simply as “data”).

  1. Processing of the data, recipients of the data

When you visit this website, we collect the following data: the date and time of your visit to a page on our website, your IP address, the name and version of your web browser, the website (URL) that you visited immediately before accessing this website, and certain cookies (see our information about the use of cookies).

In addition, we process the data that you submit to us in the context of contact requests (e.g. via our contact form or by e-mail) or via our registration form for Prospective Buyers (= creation of a Prospective Buyer’s Account).

The submission of the data marked as mandatory in the registration form for Prospective Buyers is required in order to process your registration and create a Prospective Buyer’s Account. If you do not submit this data, you will not be able to register as a Prospective Buyer.

As a Prospective Buyer, you have the opportunity to declare your interest in purchasing the apartments advertised via our portal or to bid for the chalets advertised via our portal at auction. For further details, please see our Terms of Use.

If you participate in an auction as a bidder, we process the bids that you submit.

Both when declaring an interest in purchasing and when participating in an auction as a bidder, we will ask you to send us a copy of your passport and a credit report from your bank, and will subsequently process this data.

We require the copy of your passport and the credit report from your bank in order to verify your eligibility to purchase an apartment under land transaction law and to check your credit rating. If you do not submit this data, you will not be able to purchase an apartment or to conclude a contract of purchase for a chalet at auction.

The data is used exclusively for the purpose of processing your registration, managing your Prospective Buyer’s Account (including correspondence with you and troubleshooting), verifying your eligibility under land transaction law, checking your credit rating, processing your request to purchase an apartment as well as any bids submitted by you in an auction for a chalet.

The data you submit is forwarded to Duncrow GmbH, with registered office at 6710 Nenzing, Austria, for the purpose of the aforementioned processing, and is stored and managed on its servers.

In the event that you declare an interest in purchasing an apartment or take part in an auction, your credit rating and contact details will be forwarded to the estate agent responsible for the processing of the apartments, namely Schmid & Partner GmbH in A-6900 Bregenz (hereinafter referred to as “Estate Agent”), for the purpose of checking your credit rating. In this regard, you may be contacted by the Estate Agent and asked to provide additional or more specific information. The decision as to whether your credit rating is sufficient is not based solely on automated processing or profiling. The processing of your data by the Estate Agent is governed by its data protection policy.

Should your interest in purchasing lead to the conclusion of a purchase contract or should you win an auction, all of your data will be forwarded to the Estate Agent for further processing and to the solicitor commissioned to draw up and execute the purchase contract, namely Karl Schelling in 6850 Dornbirn. The processing of your data by the solicitor is governed by the latter’s privacy policy.

  1. Purpose and legal basis of processing the data

We process the data collected during your visit to our website in order to make this website available to you, to further improve and develop this website as well as to detect, prevent and investigate attacks against our website. The legal basis for this processing is our overriding legitimate interest, which lies in achieving the goals described above.

If you contact us via our contact form, the purpose of the processing is to process your request, and its legal basis is our overriding legitimate interest in accomplishing this goal.

If you register for a Prospective Buyer’s Account, the purpose of the processing is to process your registration, to manage your Prospective Buyer’s Account, to verify your eligibility under land transaction law as well as your creditworthiness, and to process your purchase request or your participation in auctions as well as your general use of the services on this website.

The lawfulness of data processing is our overriding legitimate interest in achieving these goals.

This applies in particular to the review of your creditworthiness and the associated transmission of your data to Schmid & Partner GmbH. Here, our legitimate interest lies in minimising our credit risk and excluding parties with inadequate creditworthiness from the bidding process from the outset.

The transmission of your data to the law firm Dr. Karl Schelling for the purpose of carrying out pre-contractual and contractual measures.

  1. Right to information and right of appeal

In accordance with the applicable data protection legislation, you have the right of access, right to rectification, right to erasure, right to restriction of processing, right to object and right to data portability.

You have the right to appeal to a supervisory authority in the EU or with the Austrian data protection authority in Vienna if you believe that data protection legislation has been breached.

  1. Retention of the data (storage duration)

You can delete your Prospective Buyer’s Account at any time either by sending us a message via the above-mentioned contact details for the responsible entity, or by using the corresponding function provided in your Prospective Buyer’s Account. If you delete your Prospective Buyer’s Account during a running auction in which you have submitted a bid, you will automatically be withdrawn as a bidder. Once your Prospective Buyer’s Account has been deleted, your data will be blocked against any further use and deleted after expiry of the applicable retention periods under tax and commercial law.

We will delete your Prospective Buyer’s Account one month after the sale or auction of the last property for which you applied on this website. As a result, your data will be blocked against further use and deleted after expiry of the applicable retention periods under tax and commercial law.

  1. Facebook fan page

Our company operates a fan page on Facebook. When you visit this fan page, Facebook stores cookies on your device, regardless of whether or not you are a Facebook user. You can learn about cookies in our cookie information section.
